Employee Inventor Waivers

When a decision is made that a patent application won’t be filed by NIH or the filed patent application will be abandoned, NCI inventors may request an Employee Inventor Waiver to obtain rights to the invention. Please contact us for more information on how to apply for such a waiver or on the application status if you have already submitted such application of waiver.

NCI TTC makes determinations on certain inventorship rights, including:

  • Waiver of rights to an NIH invention to the employee inventor
  • Waiver of rights to a grantee/contractor subject invention to the inventor
  • Waiver of the US manufacturing requirement
  • Assignment of title to a grantee/contractor subject invention to third parties
